Terms and Conditions

All services listed on the websites https://ielts.jp ("PlusOnePoint") and https://ieltsmyessay.com ("IELTS MyEssay") are run by Plus One Point Pty Ltd ("the company"). By signing up to a service, you agree to be bound by the following Terms and Conditions.

1. Lesson Bookings and Cancellations

1.1 PlusOnePoint
Booking and cancellation procedures for online courses provided by PlusOnePoint differ according to the plan or program enrolled for by the student. Procedures for Private Plan and Intensive Programs (Writing Summit) are outlined below.

1.1.1. Private Plan
In the Private Plan, students use their allocated points to book classes via the designated website. All lessons must be booked using the student's portal prior to the class. Booking cancellations must also be made through the portal. Cancellation attempts via phone, email, internet forms or other methods will not be accepted.

1.1.2 Intensive Programs (Writing Summit)
Lessons for Intensive Programs (Writing Summit) are scheduled in advance, and no booking procedure is required. No make-up classes are available in case a student is unable to attend these lessons. When there are changes to lesson dates/times, students will be notified of such changes in advance.

2. Points and Course Expiry Dates

2.1 Private Plan
Regulations concerning points and expiry dates for the Private Plan are as follows:
Once enrolled, every student will receive points and an expiry date according to the purchased plan.
The course will commence on the date of purchase. No changes to the course commencement date will be accepted after the completion of enrolment.
The course expiry date and a balance of the student’s remaining points are displayed on the portal.

2.2 Intensive Programs (Writing Summit)
Regulations concerning the commencement and renewal of Intensive Programs (Writing Summit) are as follows:
The course will commence on the date specified by the student at the time of enrolment. No changes to the course commencement date will be accepted after the completion of enrolment.

3. Internet Connection

Online classes are conducted using ZOOM. It is up to students to ensure that they have a compatible computer and a stable internet connection. All students are requested to update their ZOOM software to the latest version as soon as it is released. It is strongly recommended that all students new to ZOOM complete a test-call before their first class to ensure that their settings are suitable to take part in classes. There may be occasions where lessons may be conducted using other online meeting applications such as Google Meet.

4. Lesson Cancellation and Extension of Classes

4.1 Lesson Cancellation and Extension of Classes
Lessons will not be cancelled or extended in any case except for in the following cases:
(1) There is a technical issue with the tutor's computer or ZOOM.
(2) When ZOOM issues an official notice of system failure.
(3) The tutor is in an emergency situation (explained in"4.2 Communication and support in cases of lessons not starting on time") and unable to conduct the lessen.
In the case of a class being cancelled for the reasons listed above, all points used by the student to book the class will be refunded to the personal online account of the student.
In the case of the start of a class being delayed for the reasons listed above, the finishing time of the class may be extended beyond the scheduled time without prior notice. No refund will be issued under such circumstances.

4.2. Communication and support in cases of lessons not starting on time
4.2.1. Circumstances where lessons will start late or be cancelled without prior notice
In some cases, it may be inevitable that lessons commence past the scheduled time or are cancelled. Reasons include the following:
・Technical problems
・Natural disasters
・Accidents
・Sudden illness
In every case, the administrative staff (“the Admin”) will communicate with the students who have booked the lesson in question (“the Student”) as soon as the situation is known, where possible. However, in cases of emergency, please refer to the below.
4.2.2. Method of communication in an emergency
In emergency situations where lessons do not commence at the scheduled time, it may take some time for the admin to assess the situation. Particularly for lessons held outside regular hours, such as late night and public holidays, the Admin cannot reply until the next working day. For such cases, a Slack channel is available for emergency contact between the tutor of the lesson (“the Tutor”) and the Student. Use this channel when it is necessary for the Tutor and the Student to communicate regarding the situation.
4.2.3. Lessons starting past the scheduled time
Lessons will begin with a maximum delay of 15 minutes. When lessons cannot be commenced within 15 minutes of the scheduled time, the lesson will generally be cancelled. Where lessons start late, lessons will be 50 minutes in duration, in the same way as other lessons.
4.2.4. Cancellation and refund of points
Where lessons are cancelled due to problems on part of the Tutor, all points used to book the lesson will be refunded. No other form of compensation, apart from a refund of points, will be given.
(1) Cases where a lesson is cancelled and points refunded are:
When there is no reply from the Tutor
When the Tutor does not give a reply to the Student on a specified Slack channel 15 minutes after the scheduled starting time of the lesson, the lesson will be cancelled. All points used to book the lesson will be refunded after the situation is assessed by the Admin.
When the Tutor cannot commence the lesson
Similarly, even when an update has been provided by the tutor, the lesson will be cancelled when the Tutor is unable to start the lesson within 15 minutes of the scheduled time. In these cases, the Tutor will make a decision to cancel the lesson before the 15 minutes has elapsed. All points used to book the lesson will be refunded after the situation is assessed by the Admin.
(2) In the below cases, points will not be refunded.
When a lesson is commenced, but the Student is unable to attend due to problems on part of the Student
When communication has been attempted by the Tutor and the lesson has commenced without trouble on part of the Tutor, or the lesson has commenced with less than 15 minutes delay, points used to book the lesson will not be refunded.

5. Deferment

The company does not offer an option for deferments. Take the steps outlined in "2. Points and Course Expiry Dates" to extend your course duration.

6. Course Termination

Regulations concerning expiry dates for the Flexible Plan are as follows:

If you fail to renew your enrolment before the course expiry date, your registration will be automatically terminated. If the payment is not processed in time, your enrolment will be terminated, all remaining points will be forfeited, and no backtracking can be made.
All expiry dates and times are calculated according to Australian Eastern Standard Time.

7. Enforced Termination

The company reserves the right to refuse enrolment or enforce the termination of your course enrolment with any of the following acts of infringement:
(1) Actions which cause trouble or disruption to classes and other students.
(2) Any form of abusive language or harassment directed at the Company and its employees or other members.
(3) Actions which advertise other services regardless of whether the service is provided by the student or not.
The company reserves the right to determine what constitutes the above at its sole discretion.
No refund will be issued under such circumstances.

8. Refund Policy

All matters are governed under Australian Law, and any refunds made after payments will be considered in accordance with the conditions outlined below. All requests for cancellation and refund must be submitted in writing.
(1) The student is NOT entitled to a refund of any enrolment, tuition or subscription fees unless:
a. The Managing Director deems that exceptional circumstances apply; or
b. The student has a legitimate complaint against the Company that can be substantiated under the Consumer Protection Laws of the Commonwealth of Australia or the State of Queensland.
(2) Students who have purchased additional points or extension of their expiry date are not entitled to a refund of any enrolment, tuition or subscription fees unless:
a. The Managing Director deems that exceptional circumstances apply; or
b. The student has a legitimate complaint against the Company that can be substantiated under the Consumer Protection Laws of the Commonwealth of Australia or the State of Queensland.
Note bank charges will be deducted from refunds made by overseas electronic transfer or bank draft. Some fees are non-refundable. These include enrolment fees and credit/debit card transaction fees, and may include other non-tuition fees such as subscription fees.
Refunds will be processed and paid within eight (8) weeks of the receipt of the written notification. Refunds will be made in Australian Dollars (AUD) via the internet payment system used for the original payment.

9. Transfer of Rights

Tuition fees, enrolment fees, membership fees, subscription fees, and all other handling fees cannot be transferred to a third person including family and friends.

10. Publication

10.1 Use of seminar recordings
Recordings of seminars held for students may, with care taken as to not disclose personal information, be used for the purposes listed below:
・Member-only content
・Made available for public viewing, e.g. YouTube
・On the PlusOnePoint Website and Social Media accounts, or for any other future publications.
Images or audio data containing the student or their background will not be made public without the student’s consent. Comments and questions in the Chat window, as well as user names / screen names used for comments, may be quoted directly.
10.2 Essays and Speach samples
Essays submitted to writing classes, as well as any material posted on the student channel on Slack, may be anonymously used on our Website, Social media and other future publications. Samples from speaking classes may be recorded and used on our websites with your permission.

11. Recordings of Classes and Quality Control

All online courses conducted on ZOOM may be recorded by the Company for quality control and educational purposes.
The staff in the Company, other than the specified tutor for the class, may attend classes for the purposes of monitoring and training.

12. Intellectual Property Rights

All courses and course materials, as well as material on the Website, are the intellectual property of the Company. You may not copy, publish, modify, transfer, reproduce, sell, or distribute material available in courses or the Website, in whole or in part, without the written consent of the Company. Materials may be used solely for personal, non-commercial use.
All trademarks and trade names found in course materials and on the Website are the marks of the respective owners, and their unauthorised use is prohibited. You must not record on video or audio, or relay by videophone, any online lesson without permission.

13. Change of Fees

The Company may make changes to any product and services or the fees applicable to these products and services at any time without notice.

14. Changes to the Terms and Conditions

The Company may make changes to the Terms and Conditions at any time without notice.
Any changes to the Terms and Conditions will be notified to the student.
